1. Contract Signature:
o Clients are required to sign forms and contracts electronically before their first class, session or workshop.
o Fitness clients are consenting to perform an exercise program designed by a trained fitness professional with the understanding that it may not be closely supervised by an appropriately qualified person when the client undertakes the program independently. Clients who purchase a fitness program to engage in independently assume the sole risk of doing do.
2. Cancellation Policy:
o Cancellations: Bookings must be canceled at least 24 hours in advance. Cancellations with less than 24 hours' notice will result in a cancellation fee of 100%. Classes cancelled prior to 24 hours will not be charged.
o Late Arrivals: Classes start promptly on time, and it is suggested you arrive 5-10 minutes early to get appropriately settled in. Clients who have not arrived 5 minutes prior to class start time may have their spot given to waiting standby clients.
Due to our limited staff, clients arriving to class late may locked out to avoid disruption. Please do not knock if you are late and locked out - call or email the studio if you need to discuss your missed class (please note phones will not be answered during class time).
3. Limited Liability:
o Disclaimer of Liability: Participation in fitness, dance and movement programs involves inherent risks. BodyJoy Wellness and its affiliated trainers are not liable for any injuries or damages sustained during or as a result of participation.
o Responsibility of Client: It is the sole responsibility of the client to provide accurate information. Failure to provide accurate information resulting in injury or death is the full responsibility of the client.
o Waiver of Claims: Clients waive any claims against BodyJoy Wellness and its affiliated trainers for injuries or damages related to participation in fitness programs or classes. Clients release BodyJoy Wellness and its trainers from any liability for damage or injury (including death) that may occur while exercising.
o Client Equipment: BodyJoy Wellness and its trainers are not responsible for the client's equipment. Clients waive any claims due to equipment failure and must ensure all equipment, including streaming devices and workout spaces, are in good condition for use.
4. PAR-Q Requirement:
o Physical Activity Readiness Questionnaire (PAR-Q): Clients must complete a PAR-Q before starting any fitness program. The questionnaire can be accessed and submitted online prior to the first session.
5. Confidentiality:
o Personal Information: BodyJoy Wellness and its trainers are committed to maintaining the confidentiality of all personal information, including health history and contact details. We will never sell your information to a third party and will only provide the information you have provided to another party if required by law.
o Data Protection: Personal information will be securely stored and used solely for services provided by BodyJoy Wellness. It will not be shared with third parties without explicit consent, except as required by law. Data protection is provided by Wix.com.
6. Use of Information and Intellectual Property:
o Personal Use Only: The information, techniques, and materials provided during sessions, workshops and classes are for personal use only. Clients are prohibited from reproduction or use of this information for any commercial purpose.
o Restricted Distribution: Sharing, streaming, or broadcasting of any part of BodyJoy Wellness’s intellectual property including print material, exercises and choreography without explicit written permission is prohibited. Failure to comply will result in termination of any future bookings without reimbursement, and possible legal action.
o No AI: BodyJoy Wellness does not use AI to produce any part of the provided programs and subsequent materials. BodyJoy strictly prohibits any part of the materials to be used in AI programs.
